Kerry Kenny Band / Kerry Kenny Music LLC Terms of Service & Acceptable Use Policy (the “Policy”) for Kerry Kenny Band / Kerry Kenny Music LLC Products and Services is designed to help protect Kerry Kenny Band / Kerry Kenny Music LLC  and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by Kerry Kenny Band / Kerry Kenny Music LLC. Each Kerry Kenny Band / Kerry Kenny Music LLC website or press kit user is responsible for the activities of its customer base/representatives or end-users and, by accepting service from Kerry Kenny Band / Kerry Kenny Music LLC, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of a Kerry Kenny Band / Kerry Kenny Music LLC website or press kit user will be forwarded to the Kerry Kenny Band / Kerry Kenny Music LLC website or press kit’s postmaster for action (Booking@KerryKennyBand.com). If an abuse complaint is received Kerry Kenny Band / Kerry Kenny Music LLC reserves the right to request information from the website or press kit user in order to investigate complaint.

Client Data Responsibility

It is the sole responsibility of the website or press kit user to maintain the website or press kit user’s own backup of any data. Kerry Kenny Band / Kerry Kenny Music LLC is not responsible for lost data.

Limitation of Damages or Liability

Kerry Kenny Band / Kerry Kenny Music LLC SHALL NOT BE LIABLE TO WEBSITE OR PRESS KIT USER FOR HARM CAUSED BY OR RELATED TO WEBSITE OR PRESS KIT USER’S SERVICES OR INABILITY TO UTILIZE THE SERVICES UNLESS CAUSED BY WILLFUL MISCONDUCT. Kerry Kenny Band / Kerry Kenny Music LLC SHALL NOT BE LIABLE TO WEBSITE OR PRESS KIT USERS FOR LOST PROFITS, INDIRECT, SPECIAL OR INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. NOTHWITHSTANDING ANYTHING ELSE IN THIS TERMS OR SERVICE AGREEMENT, THE MAXIMUM AGGREGATE LIABILITY OF Kerry Kenny Band / Kerry Kenny Music LLC AND ANY OF ITS EMPLOYEES, AGENTS OR AFFILIATES, UNDER ANY THEORY OF LAW SHOULD NOT EXCEED THE AMOUNT OF FEES IT HAS COLLECTED IN ONE INSTANCE OF CONTRACTUAL AGREEMENT. Kerry Kenny Band / Kerry Kenny Music LLC  PROVIDES ALL PRODUCTS AND SERVICES PROVIDED BY THE SITE AND PRESS KIT “AS IS”, WITHOUT WARRANTY OR ANY KIND, WHETHER EXPRESS, OR IMPLIED AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE. WEBSITE OR PRESS KIT USER SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE, AND SUITABILITY OF ANY PRODUCT AND SERVICE AND Kerry Kenny Band / Kerry Kenny Music LLC SHALL HAVE NO LIABILITY ASSOCIATED WITH THE FORGOING.

Governing Law

This Agreement will be interpreted and enforced in accordance with the laws of the State of Pennsylvania and Columbia County Pennsylvania and the federal laws of the United States of America applicable therein. The venue for any litigation to enforce this agreement shall be the county of Columbia and the state of Pennsylvania.
